By reserving a charter or utilizing our Service, you consent to be legally bound by these Terms. Should you not consent to any portion of these terms, you are not permitted to use the Service.
2. Service Overview
LighthouseCommonSpark offers first-rate yacht charter services, including but not restricted to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Service availability is contingent on several factors and we reserve the prerogative to alter or discontinue services at any juncture.
3. Booking and Reservations
3.1 Booking Process
To secure a charter, you must:
- Confirm that you are over 18 years of age
- Supply accurate and thorough information
- Remit the necessary deposit as indicated in your booking acknowledgment
- Accept these Terms & Conditions
3.2 Confirmation
Booking confirmation occurs only with payment receipt and our written acknowledgment. Service provision is subject to our discretion.
3.3 Availability
Charters depend on the vessel's availability and appropriate weather conditions. Efforts will be made to meet your requested dates and timings.
4. Payment Terms
4.1 Pricing
All quoted prices are in €, encompassing relevant taxes unless specified otherwise. Prices may be adjusted without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the entire charter fee is required at the time of booking
- Balance: To be paid 48 hours before the charter's departure
- Incidental expenses (if applicable): To be settled once the charter concludes
4.3 Payment Methods
Accepted payment methods include major credit cards, bank transfers, and certified cheques, processed securely and encrypted.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Full reimbursement minus processing charges
- 24-72 hours before departure: 50% reimbursement
- Less than 24 hours before departure: No reimbursement provided
5.2 Weather Cancellations
If unsafe weather conditions are determined by our captain, we will propose to:
- Reschedule the charter to another suitable date at no extra cost
- Process a complete refund if rescheduling is unfeasible
5.3 Mechanical Issues
Should your designated vessel encounter mechanical issues, we'll endeavor to supply an equivalent vessel. If this is not possible, a full refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Adhere to every directive given by the crew
- Utilize mandated safety gear when instructed
- Disclose any medical conditions that may impact their security
- Stay within assigned areas on the yacht
6.2 Prohibited Items
Items prohibited on board include:
- Glass containers
- Illegal substances
- Weapons of any kind
- Non-allowed beverages (any beverages beyond those reasonably consumed)
- Pets (unless pre-authorized)
6.3 Conduct
Passengers are expected to behave respectfully. We reserve the right to terminate a charter prematurely with no refund if passenger conduct presents a hazard or interrupts the experience for others.
7. Liability and Insurance
7.1 Our Liability
Our liability to passengers is confined to the charter price paid. We do not hold responsibility for:
- Injuries suffered due to passenger carelessness
- The loss or destruction of personal items
- Indirect, consequential, or punitive repercussions
- Delays resultant from inclement weather or unforeseen circumstance beyond our control
7.2 Insurance Coverage
We hold comprehensive marine insurance for our fleet and operations. Passengers are accountable for securing their travel and personal insurance.
7.3 Assumption of Risk
Participation in our charter services implies acknowledgment of inherent maritime risks, with you taking charge of your safety and health.
8. Modifications and Itinerary Changes
Itineraries, courses, or timetables may be altered due to weather conditions, safety considerations, or operational demands. We endeavor to provide comparable alternatives when changes are necessary.
9. Force Majeure
Events outside our control which may lead to delays, cancellations, or alterations include, but are not limited to:
- Severe meteorological conditions
- Natural catastrophes
- Regulatory decrees
- Shutdowns of seaports
- Technical malfunctions
10. Privacy and Data Protection
Your private details are processed as per our Privacy Policy. By engaging in our services, you consent to our data collection and usage as elaborated in the policy.
11. Intellectual Property
The content featured on our website, such as texts, graphics, trademarks, and images, is secured by copyright and trademark statutes. Reproduction, distribution, or the creation of derivative works requires our explicit consent.
12. Governing Law
